1. Introduction

Welcome to Nusa Justitia ("Platform", "we", or "us"). These Terms and Conditions govern your use of the Nusa Justitia legal education platform, including all content, services, and features available.

This Platform is operated in accordance with the applicable laws of the Republic of Indonesia. By using our services, you represent that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy.

2. Definitions

• "Platform" refers to the Nusa Justitia website, applications, and all available learning content.
• "User" refers to individuals who register and use the platform, including students, mentors, and administrators.
• "Content" refers to all learning materials, videos, documents, course modules, assessments, and resources available on the platform.
• "Services" refers to all features provided by the platform including online learning, mentoring, certification, and communication features.
• "Premium Content" refers to materials and services that require payment to access.

3. Eligibility and Account Registration

To use the Platform, you must:

• Be at least 17 (seventeen) years of age or have valid parental/guardian consent.
• Have legal capacity to enter into a binding agreement.
• Not be prohibited from using the services under applicable law.

When registering an account, you are responsible for:

• Providing accurate, complete, and current information (name, email, password).
• Maintaining the confidentiality of your password and account information.
• Restricting access to your account and devices.
• Notifying us immediately of any unauthorized use of your account.
• Full responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these terms or provide false information.

4. Platform Services

Nusa Justitia provides legal education services including:

• Individual learning progress tracking.

4.2 Assessments and Examinations

• Learning assessments and evaluations.
• Multiple choice, document writing, and legal argumentation exams.
• Indonesian law theory and analytical examinations.
• Automated and AI-based grading systems.

4.3 Certification

• Learning certificates upon course completion.
• Assessment certificates based on exam results.
• Certificate claiming and verification system.

4.4 Mentoring

• Mentoring sessions with experienced legal practitioners.
• Encrypted messaging system for secure communication.
• Internship and career development opportunities.

4.5 Resources

• Access to structured learning curriculum.
• Legal resource library.
• Downloadable materials and supporting documents.

5. Intellectual Property Rights

All content available on the Platform, including but not limited to:

• Text, graphics, logos, and images.
• Learning videos and audio clips.
• Course materials and supporting documents.
• Interface design and visual elements.
• Data compilations and database structures.

Is the exclusive property of Nusa Justitia or its licensors and is protected by:

• Indonesia's Law Number 28 of 2014 concerning Copyright.
• Indonesia's Law Number 20 of 2016 concerning Trademarks and Geographical Indications.
• Applicable international intellectual property laws.

6. License of Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to:

• Access and use the Platform for personal learning purposes.
• Download materials that are explicitly provided for download.
• Store content for personal offline use.

You are NOT permitted to:

• Sell, rent, or sublicense Platform content.
• Distribute, publish, or provide access to content to other parties.
• Use content for commercial purposes without written consent.
• Modify, create derivative works, or alter original content.
• Disassemble, reverse engineer, or attempt to discover source code.
• Record, download, or capture video content without permission.
• Share account credentials with others.

7. User Responsibilities

When using the Platform, you agree to:

• Comply with all applicable laws and regulations in Indonesia.
• Respect intellectual property rights and privacy of other users.
• Behave professionally in interactions with mentors and other users.
• Provide honest information in assessments and examinations.

You agree NOT to:

• Send or store material that is unlawful, harmful, threatening, abusive, or harassing.
• Spread false or misleading information.
• Take actions that may damage, disable, or interfere with Platform functionality.
• Use robots, spiders, scrapers, or other automated means to access the Platform.
• Attempt to access unauthorized areas or features.
• Cheat in assessments, examinations, or learning activities.
• Abuse the messaging system or send spam.
• Use the Platform for unlawful activities.

8. User Content

You retain ownership of content you upload to the Platform (such as assignments, documents, profile photos). However, by uploading content, you grant us:

• A non-exclusive license to use, store, and display that content for Platform operations.
• The right to review and remove content that violates terms.

You warrant that content you upload does not infringe on third-party rights and complies with applicable law.

9. Payment and Premium Content

9.1 Pricing and Payment

• Prices for premium content are displayed in Indonesian Rupiah (IDR) and include applicable taxes.
• Payments are processed through Midtrans with various methods (credit card, bank transfer, e-wallets like GoPay and ShopeePay, QRIS, or retail outlets).
• Access to premium content is granted after payment is successfully confirmed.

9.2 Refund Policy

• Refunds may be requested within 7 (seven) days of purchase if you have not accessed more than 20% of the content.
• Refund requests must be submitted via email to refund@nusajustitia.id.
• Refunds are processed within 14 (fourteen) business days after approval.
• Administrative or transfer fees may apply according to payment provider terms.

9.3 Price Changes

We reserve the right to change service prices with prior notice. Price changes do not apply to already confirmed purchases.

10. Mentoring and Communication

• Mentoring sessions are conducted according to schedules agreed between users and mentors.
• Communication through the Platform messaging system is encrypted for security.
• Mentors are independent professionals and their opinions do not represent official Nusa Justitia positions.
• We are not responsible for legal advice given during mentoring sessions.

11. Certification

• Certificates are issued based on course completion or achieving minimum scores in assessments.
• Nusa Justitia certificates are proof of learning participation and do not constitute a professional license to practice law.
• We reserve the right to revoke certificates if fraud or violations are discovered in the acquisition process.

12. Disclaimer of Warranties

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. Specifically, we do not warrant that:

• The Platform will be error-free, virus-free, or free of harmful components.
• Access will be continuous, uninterrupted, or secure.
• Results obtained from Platform use will be accurate or reliable.
• Learning content will always be current with the latest legal developments.

Learning materials on the Platform are educational in nature and are not intended as professional legal advice. For specific legal matters, consult a licensed attorney or legal consultant.

13. Limitation of Liability

To the extent permitted by applicable law, Nusa Justitia is not liable for:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, or business opportunities.
• Costs of procuring substitute services.
• Damages arising from use or inability to use the Platform.

Our total liability in any event shall not exceed the amount you have paid to us in the last 12 (twelve) months.

14. Indemnification

You agree to defend, indemnify, and hold harmless Nusa Justitia from all claims, losses, damages, liabilities, and costs (including attorney fees) arising from:

• Your use of the Platform.
• Your violation of these Terms and Conditions.
• Your violation of third-party rights.
• Content you upload or share through the Platform.

15. Suspension and Termination

We reserve the right, at our sole discretion, to:

• Suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms and Conditions.
• Remove content that violates or is inappropriate.
• Deny access to all or part of the Platform.
• Take legal action against serious violations.

You may terminate your account at any time through account settings or by contacting us.

16. Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Changes will:

• Be announced via email or notification on the Platform.
• Take effect immediately upon posting (unless otherwise stated).
• Bind you if you continue to use the Platform after changes take effect.

We encourage you to review these Terms and Conditions periodically.

17. Governing Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Indonesia.

Disputes arising from or related to these Terms and Conditions will be resolved through:

• Deliberation: The parties will attempt to resolve disputes amicably within 30 (thirty) days.
• Mediation: If deliberation fails, disputes will be resolved through mediation.
• Arbitration: If mediation fails, disputes will be resolved through arbitration at the Indonesian National Arbitration Board (BANI) according to applicable BANI rules.

18. General Provisions

• Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.
• Waiver: Our failure to enforce any provision does not constitute a waiver of our right to enforce it later.
• Assignment: You may not assign your rights or obligations under these Terms and Conditions without our written consent.
• Entire Agreement: These Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between you and Nusa Justitia.
